Is Airbnb legal in Penang?
- Short-term rental is permitted in Penang, but the practical question is whether your specific building allows it. Most condos in tourism areas (Tanjung Tokong, Tanjung Bungah, Batu Ferringhi, Karpal Singh Drive) actively permit short-stay. Many KL-style residential-only condos do not.
- Always check your building's MCST house rules and AGM minutes before listing. MyBnB checks this for every unit during onboarding.
Building-level (MCST / JMB) rules to check
- Does the building permit stays under 3 nights, 7 nights, or only 30+ nights?
- Is there a daily / nightly access fee for short-stay guests?
- Are there registration requirements at the management office before check-in?
- Are there restrictions on key handover, lockboxes or self check-in?
- Is there a guest-to-unit ratio cap (commonly 2 per bedroom + 2)?
Tax — what owners owe LHDN
- Short-stay rental income is taxable. Owners typically report it as rental income under Section 4(d) of the Income Tax Act, or as business income under Section 4(a) if managed at scale.
- Allowable deductions usually include OTA commission, management fees, housekeeping, repairs, utilities (proportionate), insurance and depreciation of furnishings.
- Tourism Tax (TTx) of RM10/night applies to foreign guests for licensed accommodation operators; OTAs collect this automatically on most platforms.
- We are not tax advisors — speak to a Malaysian-licensed accountant for your specific situation.
What MyBnB handles for you on compliance
- House-rule check during onboarding so we don't list a unit that's not allowed to operate.
- Guest ID collection and registration where the building requires it.
- Monthly statement broken out so your accountant can file cleanly.
Frequently asked questions
Do I need a license to Airbnb my Penang condo?
There is no separate federal Airbnb license in Malaysia as of 2026, but you must comply with your building's MCST house rules and report income to LHDN. Some states are tightening rules — stay updated.
What happens if my condo bans short-stay?
Listing in defiance risks fines, key deactivation and legal action from the MCST. If your building bans short-stay, MyBnB cannot operate the unit. We check this before signing.
Is Tourism Tax (TTx) included in guest pricing?
On most OTAs, TTx is collected directly from the foreign guest at booking and remitted automatically — owners don't see it in their payout.
